§ 102-95. Right to appeal.

  • (a)

    Parking violations may be informally appealed to the city police department by the alleged violator. Informal appeals may be filed on forms available at the city police department or on the city's website. The alleged violator shall be notified in writing or via email of the decision regarding the appeal. An informal appeal must be submitted within seven days of the date of issuance of the violation.

    (b)

    If, after investigation, the police officer assigned by the police chief shall find that because of a defective parking device, improper or missing sign, or other mitigating circumstances that the violation should not have been issued the violation may be disposed of without penalty and the police officer shall notify the parking violations bureau of the same.

Ord. No. 2010-7, § 2, adopted June 21, 2010, amended the Code by, in effect, repealing former § 102-95, and adding a new § 102-95. Former § 102-95 pertained to spaces for handicappers, and derived from the Code of 1970, § 40-142. Similar provisions can now be found in § 102-99.
