§ 94-240. Filing and referral of applications; investigation and hearing by planning commission.

  • (a)

    Pre-application consultation. Individual applicants shall schedule a pre-application consultation with the planning department not less than one week before the planning commission filing deadline. The purpose of this pre-application consultation is to provide applicants with information pertinent the procedure for right-of-way vacations. Materials presented and discussions held during such consultation shall be for informational purposes only and shall not be legally binding on either the applicant or city. There shall be no fee for this consultation process.

    (b)

    Filing of application. All applications for vacation proceedings shall be filed with the planning commission. The planning commission shall investigate the merits of the vacation and shall hold a public hearing thereon and shall give notice thereof according to its rules and practice; provided, however; that notice thereof shall be given to the city manager, who shall cause such departments as he deems necessary to state, either in person at such hearing or in writing filed previous to the hearing, whether the department favors or opposes the proceedings and the reasons therefor.
