§ 94-103. Installation procedure.

  • (a)

    Installations of boulevard lighting and ornamental street lighting, financed in whole or in part by special assessment, shall be made either upon resolution of the city commission after a two-thirds vote or upon a petition therefore in writing directed to the city commission, signed by a majority of the property owners along a street or a part thereof, owning a major portion of the frontage affected thereon or thereby. The proceedings in reference to such petition, and all other proceedings relative to the installation, assessment of cost, and the collection thereof, insofar as such cost constitutes a local improvement as provided in section 94-102, shall be in accordance with this article and chapter 90 of this Code.

    (b)

    The installation of boulevard lighting and ornamental street lighting shall be made by or under the supervision of the electric light department of the city, and where labor and materials, or either, are furnished by the city, the cost thereof to the city shall constitute a part of the total cost of such installation upon which the percentage constituting a local improvement shall be computed.
