§ 74-202. Prohibited on streets and front yards.

  • (a)

    Disabled motor vehicles shall not be permitted in the rights-of-way of the streets, alleys or highways within the city except for towing or similar transportation.

    (b)

    Disabled motor vehicles shall not be permitted in a front yard of a premises as defined in chapter 122 of this Code.

    (c)

    The registered owner of any motor vehicle shall be presumptively responsible for a violation of this section. If the registered owner cannot be ascertained with reasonable inquiry, then the assessed owner of the premises shall be presumptively responsible for a violation of this section.

    (d)

    It shall be an affirmative defense to this section to show that the disabled motor vehicle became disabled while upon a public street or front yard and that removal or repair occurred within 48 hours.
