§ 34-146. Issuance of permit.
(a)
The city engineer, or his designee, after reviewing the application, which includes the required construction plans and survey, shall make a written recommendation to the city planning commission as to the issuance of the requested permit. The city engineer's, or his designee's recommendation shall be based on the application's compliance with and conformity to the requirements of this article including the factors listed in section 34-140, above.
(b)
After receiving the recommendation from the city engineer, or his designee, the city planning commission shall review the application and shall either approve the application and issue the permit or deny the application. The city planning commission shall make a record of the application review process.
(c)
The city planning department shall return a denied application to the applicant with a written statement detailing the reasons for the application's denial.
(d)
The applicant may appeal the denial of an application to the city zoning board of appeals.
(e)
The city planning commission shall either approve or deny the application within 45 days after the provider submits its application to the city engineer, or his designee.
