§ 30-281. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Applicant means any person that desires or is required to be licensed under this article.

    Apprentice or student means any person, who, under the guidance of an instructor in a massage establishment, is being trained or instructed in the theory, method or practice of massage.

    Employee means any and all persons employed by a massage establishment or any person who renders any service to a customer on the massage establishment's premises and receives compensation for such service.

    Instructor means any person who gives lessons or teaches the theory, method or practice of massage.

    License means the document issued under this article that enables a person to operate a massage establishment.

    Massage means any method of pressure on or friction against, or stroking, kneading, rubbing, tapping, pounding, vibrating or stimulating of the external soft parts of the body with hands or with the aid of any mechanical or electrical apparatus or appliance with or without rubbing alcohol, liniments, antiseptics, oils, powders, creams, lotions, ointments or other similar preparations used in this practice.

    Massage establishment means a building or portion thereof that is used primarily for the practice of body massage on the human body for compensation and for other than cosmetic or beautifying purposes, with or without the use of non-powered mechanical or bathing devices; the definition of massage establishment includes but is not limited to massage parlors and massage schools.

    Massage parlor means any place or establishment where a massage is made available, or any place or establishment where steam baths, freestanding saunas and/or Jacuzzis are made available for a fee if the majority of the revenue of the establishment or place is derived from steam baths, freestanding saunas and/or Jacuzzis.

    Massage school means a school recognized by the state board of massage that requires for admission students with a tenth grade education or its equivalent; that employs one (1) or more state licensed massage therapists as instructors; and that has minimum requirements of a continuous course of study and training and consists of study in physiology, anatomy, massage theory, hydrotherapy, ethics and practical massage, which courses of study and training are approved by the state.

    Owner means a person who conducts, operates or owns a massage establishment.

    Person means an individual, sole proprietorship, partnership, association, corporation, firm or other form of business organization or group, or the individuals comprising such business organization or group.

    Sexual area or genital area means the genitals, pubic area, buttocks, anus or perineum of any person or the breasts of a female.
