§ 94-185. Special provisions for joint ownership.

  • When any street, avenue, alley or public place is torn up for the purpose of laying underground conduits and the same is to be used by more than one person as joint owners in the conduit, the expense of constructing the same shall be borne by all parties occupying the trench; provided, that the work of excavation or restoring the street, avenue, alley or public place shall be done at the same time and may be done by one of the parties interested in the work. In case of disagreement by the parties interested as to who shall perform the work of excavation and restoring the street, avenue, alley or public place to its former condition, then the work shall be performed by the city under direction of the superintendent and the expense thereof shall be paid by the parties occupying the conduit proportionately, the proportion thereof to be determined by the superintendent, whose decision thereon shall be final.
