§ 94-45. Grades and lines.

All sidewalks upon paved streets shall be laid to conform to the grade of the street as established for paving the same, and all other sidewalks shall be laid to such grade and line as may be fixed by the city engineer. It shall be the duty of the engineer, when any sidewalk is to be constructed, to fix the grade and line thereof. Wherever shade trees and other obstructions are in the way of establishing such a sidewalk line, the line may be varied by the engineer to conform with the permanent sidewalk already laid and to prevent the removal of shade trees or other obstructions that may interfere with the establishing of a proper sidewalk line.
