§ 94-1. Obstructions and encroachments generally.

  • (a)

    It shall be unlawful for any person to place or maintain, or to permit to be placed or maintained, any obstruction on or above any sidewalk, street or other public way within the city unless pursuant to a written permit issued by the city engineer or other designated city department. All encroachments shall be erected in and maintained in accordance with the permit and the ordinances and codes of the city.

    (b)

    The city manager may authorize the temporary erection of flags and other suitable decorations along the public streets, on such terms and conditions as deemed necessary as decorations for the observation of holidays, parades or other civic functions.

    (c)

    The city manager or the city engineer may order the immediate removal of any encroachment found to constitute a hazard to persons using the public way. Unauthorized encroachments may be removed immediately by the city at the cost of the owner.
