§ 58-3. Appearance ticket.

  • (a)

    As used in this chapter, "appearance ticket" means a complaint or written notice issued and subscribed by the code official, directing a designated person to appear in the district court at a designated future time in connection with his alleged commission of a designated violation of this chapter.

    (b)

    The code official is hereby authorized to issue and serve an appearance ticket upon a person if the code official has reasonable cause to believe that the person has committed an offense.

    (c)

    The appearance tickets shall be numbered consecutively, be in such form as determined by the attorney general, the state court administrator and the director of the department of state police and shall consist of the following parts:

    (1)

    The original, which shall be a complaint or notice to appear by the code official and filed with the district court.

    (2)

    The first copy, which shall be the abstract of court record.

    (3)

    The second copy, which shall be retained by the code official.

    (4)

    The third copy, which shall be delivered to the alleged violator.

    (d)

    Nothing contained in this section shall be construed to limit the authority of a police officer, granted under state statute, ordinance, common law or other provision, to arrest any person or to issue an appearance ticket for any violation of law, including a violation of this article.
