§ 38-29. Sale of lots—Generally.

  • Any person desiring to purchase a lot in the cemetery shall make application to the cemetery superintendent.

    (1)

    If such person decides to pay for the lot in full, the superintendent shall take the money, give the purchaser a receipt in full, and the superintendent shall thereupon go to the city clerk and the city clerk shall thereupon issue a deed to the purchaser, whereupon the superintendent shall forthwith pay the money into the city clerk's office.

    (2)

    If the lot is purchased on installments, the superintendent and the purchaser shall enter into a contract, which shall be executed in triplicate and signed by both parties, one copy of the contract to be retained by the superintendent, one copy by the purchaser and the original delivered to the city clerk as a permanent record. The superintendent shall pay to the city clerk the down payment which he shall receive on the lot. Payments shall be made over three years, on a quarterly basis, with one-half of one percent interest per month on the balance remaining due, to the city clerk. If the purchaser falls delinquent three quarterly payments, the purchaser forfeits all previous payments. The minimum down payment on all lots shall be ten percent of the contract price.

    Upon full and complete payment of all installments due, the city clerk shall forthwith execute and deliver a deed in the name of the city to the party entitled thereto, and record a copy of the deed in a register to be kept by him for that purpose.
