§ 34-39. Permit, license, etc., from FCC as prerequisite to issuance.

No franchise shall be granted under this article until the applicant has established that he has obtained any permit, license or order required by any rule, order or regulation of the Federal Communications Commission which has been promulgated prior to city commission action on his application. If the applicant alleges that no such permit, license or order from the Federal Communications Commission is required for the proposed video services operation for which a franchise is sought, it shall establish such fact to the satisfaction of the city commission. A written statement to that effect from the Federal Communications Commission shall be deemed sufficient proof of such fact.
