§ 2-64. Subpoenas of commission.

  • Whenever the city commission shall issue a subpoena compelling the attendance of a witness before the city commission, or a committee of the city commission, which subpoena may also compel the production of designated books, papers, documents or tangible things, it shall be the duty of every witness served with the subpoena to obey the command of the subpoena and to attend at the time and place named in the subpoena and to bring the designated books, papers, documents or tangible things directed to be produced in the subpoena. It shall be the duty of the subpoenaed witness to truthfully answer all questions regarding any matter, not privileged, which is relevant to the subject matter of the city commission's, or a committee of the city commission's, inquiry, including the existence, description, nature, custody, condition and location of books, papers, documents or other tangible things, and the identity and location of persons having knowledge of the subject matter of the city commission's, or a committee of the city commission's, inquiry. Questions and the demand for books, papers, documents or other tangible things shall be relevant if they in any manner bear upon or pertain to the subject matter of the inquiry. If the witness fails to appear, or to testify, or to produce the subpoenaed books, papers, documents or other tangible things, the witness shall be guilty of a misdemeanor and be subject to the penalties in chapter 1, section 1-15. In addition to criminal penalties, the commission may suspend or terminate any contract or the conduct of any business between the city and the witness or any entity owned in any part by or employing the witness if the inquiry bears upon any contract, agreement, transaction or conduct of business with the city. The commission also may prohibit the witness or any entity owned by or employing the witness from any contracts, agreements, transactions or conduct of business with the city in the future.
