§ 106-421. Failure to obey let it run order.

  • (a)

    When the water department superintendent issues a "let it run" order to an individual water customer at a specified address as provided in section 106-420 the customer shall run tap water at the rate directed in the order and for the time period directed in the order.

    (b)

    If the water customer fails to run tap water as provided in the order, causing the water service to freeze, the city shall thaw the service without charge to the customer on the first two occasions.

    (c)

    If the water customer fails to run tap water as provided in the order, causing the water service to freeze on a third, or more, occasion the city shall thaw the service and the customer shall be charged a fee. The fee for thawing the service shall be the fee on file with the city clerk which has been approved and filed by the city manager and of which the city commission has been notified for at least 30 days in compliance with section 2-1 of the Bay City Code of Ordinances.

    (d)

    If the customer fails to pay the charge the city shall have a lien as security for collection as provided in section 106-441 of this code.
