§ 106-95. Most restrictive standards and requirements apply.

  • Notwithstanding any provision of this article to the contrary, the most stringent or restrictive standard or requirement applicable to a user's discharge shall control, whether established by this article, by any notice, order, permit, decision or determination promulgated, issued or made by the POTW under this article, by state laws or regulations, including the POTW's NPDES permit, or by federal laws or regulations. Further, if state or federal laws or regulations provide for standards and requirements not covered by this article that are otherwise applicable to a user's discharge, those standards and requirements shall apply to the user in addition to those required by this article, and the most restrictive of those additional standards or requirements shall control and shall be complied with by the user immediately or within the time period specified by the law or regulation.
